TERMS AND CONDITIONS

Welcome to Merli’s Adventure! These Terms and Conditions (“Terms”) govern your access to and use of the web game provided by Kingsmen Exhibits Pte Ltd (“we,” “us,” or “our”), developed for Singapore Tourism Board (“Client”). By accessing or playing Merli’s Adventure, you agree to these Terms.
1. Acceptance of Terms
By using Merli’s Adventure, you acknowledge that:
- You have read, understood, and agreed to be bound by these Terms, including our Privacy Policy. The Terms may be amended from time to time without further notice, and you agree to the amended Terms each time you access and use Merli’s Adventure. If you do not agree, please discontinue use immediately; and
- You are at least 18 years old, or have obtained the consent of your parent or guardian to access Merli’s Adventure. If you are the parent or guardian of a minor aged 18 or older (depending on the applicable laws of your country), you are agreeing to these Terms on your behalf and on behalf of your minor(s) who you have authorised to use Merli’s Adventure pursuant to these Terms.
We and our Client grants you a non-exclusive, non-transferable licence, to access and use Merli’s Adventure for your personal use only, unless we expressly state otherwise in writing. You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to Merli’s Adventure is owned by or licensed to us and/or our Client. You agree not to use Merli’s Adventure for anything else, and specifically, you agree that you shall not utilise bots, crawlers, scrapers or other automated means to access or collect data or other content from Merli’s Adventure.
2. Game Access and Use
- Merli’s Adventure is designed for mobile devices and requires an internet connection. You are responsible for the internet connection and/or mobile charges that you may incur for accessing and/or using Merli’s Adventure.
- The game uses the front camera to track head movements for gameplay.
- You may not use the game for any unlawful purpose or in a manner that violates any applicable laws.
- You agree not to communicate, transmit or otherwise make available any information, data, software, sound, photographs, graphics, video, messages, or other materials via Merli’s Adventure (“Content”) or otherwise use Merli’s Adventure in any way:
- that is or could reasonably be viewed as unlawful, harmful, harassing, grooming, defamatory, libellous, obscene or otherwise objectionable;
- that is or could be reasonably viewed as toxic and/or abusive behaviour, or behaviour that is intended to unreasonably undermine or disrupt the experiences of others or affect other players;
- that is or could reasonably be viewed as invasive of another’s privacy or violate any privacy rights;
- that is likely to, or could reasonably be viewed as likely to incite violence, terrorist activities or racial or ethnic hatred; and/or
- which infringes any intellectual property right or other proprietary right of others.
- We and/or the Client have the right to remove uploaded Content from Merli’s Adventure if we decide in our sole discretion that it results in or from a breach of any part of these Terms, or that it may bring us, our Client or Merli’s Adventure into disrepute.
3. Privacy and Data Collection
- Information, data, software, sound, photographs, graphics, video, messages, tags, usernames, guild names or other materials may be sent, uploaded, communicated, transmitted or otherwise made available via Merli’s Adventure by you or another user (“Content”). You understand and agree that all Content that you may be sent when using Merli’s Adventure, whether publicly posted or privately sent, is the sole responsibility of the person that sent the Content. This means that you are entirely responsible for all Content that you may upload, communicate, transmit or otherwise make available via Merli’s Adventure.
- The game may collect certain data, including camera input, to enable gameplay features. However, we do not store, share, or process facial recognition data.
- Our use of cookies and data collection practices are outlined in our Cookie Policy.
4. Limitation of Liability
By using Merli’s Adventure, you acknowledge that:
- The game is provided “as is” without warranties of any kind.
- You acknowledge and agree that you are playing Merli’s Adventure at your own risk, and we and/or the Client shall not be responsible for any device issues, data loss, personal injury (to the extent permitted by law), property damage or any losses suffered by you arising from or in connection with your access and use of Merli’s Adventure.
5. Termination
We reserve the right to suspend temporarily or permanently or terminate your access to Merli’s Adventure at our discretion if you violate these Terms. Additionally, we may otherwise disable access to Merli’s Adventure at our sole and absolute discretion and may do so without notice to you.
6. Governing Law
These Terms shall be governed by the laws of the Republic of Singapore. You agree to the submit to the exclusive jurisdiction of the Singapore courts in the event of any dispute.
